Anti-fire sale laws too late for Joan

AS her Sunshine Coast hinterland property goes under the hammer today, 81-year-old Joan George finds little comfort in new Queensland laws cracking down on mortgage fire sales. In light of the global financial crisis, the groundbreaking legislation was rushed through Queensland parliament this week to protect vulnerable land owners, such as Ms George and her son Matthew, from losing equity when their properties are repossessed. The Georges’ 24ha block will be auctioned today. Mr George said the property had received limited and unflattering advertising designed to attract only bargain-hunters, potentially leaving him with little to no equity. The property was valued in May at $760,000 but Mr George believes the auction will not yield an appropriate sale price as the property has not been adequately advertised.

Highway beats dam in forced sale offer

“We were being approached by both Main Roads because of the highway, and DNR because of the dam, which both affect our property,” Melody said. “Main Roads accepted our hardship claim in June last year and we settled with them. The whole thing was finalised, and then the water people from DNR got onto us with their valuation to take our land for the dam”. “I thought if the DNR offer is more than we’d accepted from Main Roads, I was just going to tear up the envelope,” Melody said. “But it was actually $180,000 less, so it was very lucky for us we had accepted the Main Roads offer.”
